South African expats planning trips home may face unexpected complications at the border following a Constitutional Court ruling in May 2025 that changed how South African citizenship is recognised.

While this ruling corrected an unconstitutional section of the law, it has created real-world travel challenges for many South Africans living abroad, especially those who believed they had lost their South African citizenship years ago.

Here’s what you need to know before you travel.

 

What Changed?

Since 1995, South African law stated that citizens who voluntarily acquired another country’s citizenship automatically lost their South African citizenship, unless they had applied for permission to retain it.

However, in May 2025, the Constitutional Court ruled that this section of the law was unconstitutional.

As a result, many South Africans who believed they had lost their SA citizenship were suddenly reinstated as South African citizens, automatically and retrospectively.

 

Why This Matters for Travel?

South African law requires that South African citizens must enter and exit the country using a South African passport, even if they hold dual citizenship.

This means:

  • Entering or leaving South Africa on a foreign passport is technically an offence
  • Penalties can include fines or imprisonment of up to 12 months

For expats who no longer hold a valid South African passport, this creates serious uncertainty.

 

Real-Life Impact

One reported case involved a South African woman living in Australia who had to cancel a Christmas trip home after learning that her citizenship had been reinstated.

She confirmed her status through a new Home Affairs online portal, launched in November 2025, and was advised by the South African Consulate that travelling on her Australian passport would be unlawful.

Her situation highlighted a growing issue affecting many expats worldwide.

 

What Are Your Options If You’re Affected?

If your South African citizenship has been reinstated, you may need to consider one of the following:

1. Apply for a South African Passport

  • Current turnaround time: approximately 5 weeks
  • Available via new Home Affairs centres

2. Apply for an Emergency Travel Certificate

  • Usually accepted one-way only
  • Often used for compassionate or urgent travel
  • You may still need to apply for a SA passport before returning abroad

3. Renounce South African Citizenship

  • Processing time: 6–12 months
  • May soon be selectable via the Home Affairs online portal (expected rollout)

 

Are Border Officials Being Lenient?

According to DA Abroad, border authorities are aware of the situation and have been reasonably lenient, recognising that many expats are still in the process of sorting out documentation.

However, leniency is not guaranteed, and enforcement may vary by port of entry.

Most airlines follow a similar structure, but the fine print matters. Here’s what you can usually expect:

Size & Weight

  • Typically 7–10kg
  • One small cabin case
  • Plus one personal item such as a handbag or laptop

Liquids & Restrictions

  • Liquids under 100ml each in a clear zip-lock bag
  • No sharp items or restricted batteries
  • Keep medication, valuables, and electronics with you

 

2. Checked-In Baggage: What You Can Put in the Hold

Checked baggage rules vary slightly between airlines and ticket types.

Typical Weight Allowances

  • Economy: 20–23kg
  • Premium: 25–30kg
  • Business/First: Up to 32kg per bag

Number of Bags

  • Some fares include one checked bag, others include two
  • Extra bags or overweight bags come with additional charges

 

3. PIECE vs WEIGHT Concept — What’s the Difference?

This is one of the most confusing parts of baggage rules, especially for multi-stop or international trips. Airlines use one of two systems to determine what you’re allowed to check in:

* PIECE Concept
Under the piece system, your allowance is based on how many bags you can take, not just the total weight.

Typically:

  • 2 bags, each weighing up to 23kg (economy)
  • Business and First may allow 2 x 32kg bags
  • Each bag must not exceed 23kg/32kg, depending on the class

Important:
If you exceed the weight on one bag, even by 1kg, you may be charged for overweight, even if your second bag is much lighter.

Example:
You’re allowed 2 x 23kg.
Bag 1: 26kg → overweight fee
Bag 2: 17kg → fine
But airlines do not combine the weight of both bags.

This system is strict: it cares about the number of bags and weight per piece.

 

* WEIGHT Concept (Common on many international & African routes)

Under the weight system, you’re given a total weight allowance, and you can divide it into multiple bags.

Typically:

Economy: 20kg or 23kg total
Premium: 25–30kg total
Business: 30–40kg total

You can check:

More than one bag,
As long as each bag is under 32kg,
And your total combined weight stays within your allowance.

Example:
You have 30kg economy allowance.

You may check:

  • One 20kg bag + one 10kg bag (total 30kg), OR
  • Three lighter bags totalling 30kg

It’s more flexible, especially for families sharing luggage.

What is your refund and cancellation policy?

All service fees and facilitation fees are Non-refundable.
Package, flight and accommodation refunds will be advised as and when bookings are made – as this will vary according to date of departure and prices paid. Cheaper options or the Cheapest options are 99% of the time NON-REFUNDABLE – more expensive options generally offer less restricted refunds. This will be advised on booking.
